The petitioner seeks bail in a case instituted under Sections 467, 468, 471, 419, 420 and 120B/34 of the Indian Penal Code.

The allegation against the petitioner is that one mobile of Samsung company bearing no. 9102811959 along with two copies containing the mobile number of different States are said to have been recovered from the possession of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.08.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court Cr.Misc. No.44317 of 2016 (2) dt.18-10-2016 2/2 petitioner has been made accused due to mistake of fact. No incriminating article is said to have been recovered from the possession of the petitioner, except for two copies and one mobile.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.1st, Sheikhpura, in connection with Shekhopur Sarai P.S. Case No. 68 of 2016.
