ANJANA MISHRA ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with patehpur P.S. Case No. 14/14 registered for the offences punishable under Sections 147,148,149,323,324,308,379 of the Indian Penal Code.
Learned counsel for the petitioner submits that the there is history of litigation between the parties as earlier also, the mother of the informant had lodged Fatehpur P.S. Case No. 13 of 2012 in similar sections whereas the petitioner and his family being aggrieved by the act of the informant and his mother had earlier lodged Fathepur P.S. Case No. 12 of 2012. Learned counsel for the petitioner further submits that again this time the informant has lodged the Patehpur P.S. Case No. 08 of 2014 under Sections
Patna High Court Cr.Misc. No.43525 of 2014 (2) dt.16-04-2015 P2/2 147,148,323,324,307,508,341,342 of the Indian Penal Code that the petitioner and his family members have brutally assaulted the informant.
Considering the fact that the allegations are mere counter blast of the case filed by the petitioner and also the fact that there is no other criminal antecedent save and except one stated in paragraph No. 3 of the present application, let the petitioner, in the event of his arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Patepur P.S. Case No. 14/2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
