2. The petitioners seek bail in connection with Silao PS Case No. 251 of 2023 instituted for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
3. As per the prosecution case, it is case of dowry death due to non-fulfillment of dowry demand by the petitioners and his family members.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence and have falsely been implicated in this case. He further submits that the petitioners are father-in-law and mother-in-law of the
Patna High Court CR. MISC. No.25248 of 2024(2) dt.09-04-2024 2/3 deceased and they are living separately by mess. He next submits that the husband of the deceased is in judicial custody. There is general and omnibus allegation against the petitioners. Petitioners have got no criminal antecedent as stated in para 3 of the petition and is in custody since 18.01.2024.
5. Learned APP opposes the prayer for bail.

From perusal of the FIR and the impugned order of the learned 7th Additional District and Sessions Judge, Nalanda, Biharsharif dated 22.02.2024, it appears that petitioners are father-in-law and mother-in-law of the deceased and the husband of the deceased is already in judicial custody. From perusal of the FIR, it also appears that the informant has lodged a case under sections 304(B)/34 of the Indian Penal Code against three accused persons including the petitioners. In the instant petition at para no. 12, it is stated that the informant has also filed a petition before the trial Court in which he has stated that the daughter of the informant was abnormal and she herself committed suicide, so FIR named accused persons are innocent and in anger he had lodged this case, accordingly the prayer for bail of the petitioners are allowed. Let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like
Patna High Court CR. MISC. No.25248 of 2024(2) dt.09-04-2024 3/3 amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Biharsharif, Nalanda in connection with Silao P.S. Case No. 251 of 2023.
