JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, Earlier prayer for bail of the petitioner was rejected by this court but learned counsel for the petitioner points out that having more or less similar allegation, one co-accused namely, Riyaz Ahmed has already been granted privilege of bail by a coordinate bench of this court vide order dated 02-09-2016 passed in Cr. Misc. No. 29365 of 2016.

It appears from the aforesaid fact that a fresh ground has accrued in favour of the petitioner because there should be parity of justice between two persons.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten

Patna High Court Cr.Misc. No.46672 of 2016 (3) dt.23-11-2016 2/2 thousand) with two sureties of the like amount each in connection with Majorganj P.S. Case No. 94 of 2016 to the satisfaction of Chief Judicial Magistrate, Sitamarhi.
