The Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 307/34 of the Indian Penal Code.

As per the F.I.R., while the informant was at his door, all the F.I.R. named accused persons including these petitioners abused and assaulted the informant and his wife. It is submitted on behalf of the petitioners that the specific accusation of assault is against other co-accused persons. So far as these two petitioners is concerned there is general and omnibus allegation. There is case and counter case

Patna High Court CR. MISC. No.22924 of 2023(2) dt.26-06-2023 2/2 between the parties and both sides sustained injury and the petitioners have got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances and the fact that the land in question has already been mutated in favour of the complaint, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gaya, in connection with Paraiya P.S. Case No. 219 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
