The sole petitioner, apprehending his arrest in C-1 Case no.214/2017 registered for the offence under Section 30(a) read with Section 13 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender.
It was submitted by learned counsel for the petitioner that to the reasons best known to the Excise officials, the petitioner has been arrayed as accused in Column no.2 of the report submitted by the Excise Officer. He submits that as per prosecution report, it appears that one three-wheeler was
Patna High Court Cr.Misc. No.23785 of 2017 (5) dt.10-08-2017 2/2 intercepted, from which huge quantity of Indian Make foreign liquor as well as beer was recovered and from the said vehicle two persons, namely, Banti Singh and Ashok Sah were apprehended. He submits that nothing has been indicated as to how the petitioner's name has come.
Considering the nature of accusation, let the petitioner, namely, Mukesh Bhagat , in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge, Katihar in connection with C-1 Case no.214/2017 , subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
