The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has antecedent of one case and the prosecution case in brief is that on 13.10.2021 at about 9:00 PM, when the informant had gone to Durga Sthan, Majlishpur, where Pappu Kumar Singh and the petitioner abused and scuffled with him and they also fired with an intent to kill him but he was saved. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is

No.23414 of 2022(2) dt.20-10-2022 2/2 next submitted that from bare perusal of the allegation as alleged in the FIR it would manifest that allegation is of scuffling and abusing the informant when no injury was suffered by him, it is also submitted that as far as allegation of firing is alleged the same is ornamental in nature as no injury was caused.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bidupur P.S. Case No. 493 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
