The petitioners, who are in custody since 24.02.2020, seek bail in connection with Shankarpur P.S. Case No. 76 of 2019 (CIS No. 797 of 2019), dated 14.05.2019, instituted for the offences under Sections 365

Patna High Court CR. MISC. No.21739 of 2020(2) dt.07-07-2020 2/3 and 120B of the Indian Penal Code.

The son of the informant is stated to have been kidnapped by the petitioners. Later, it transpired that an attempt was made to get one of the sons of the petitioners married to some girl. The statement made by the victim boy recorded under Section 164 Cr.P.C. indicates that the marriage could not be performed as the police intervened and the victim was brought to the police station. It has been submitted on behalf of the petitioners that it is a case of love affairs and only when the parents of the groom were not desirous of accepting the marriage, this kind of false case has been instituted.

The petitioners claim to be persons of clean antecedents.

Considering the facts afore-stated and the period of custody of the petitioners, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Madhepura in

Patna High Court CR. MISC. No.21739 of 2020(2) dt.07-07-2020 3/3 connection with Shankarpur P.S. Case No. 76 of 2019 (CIS No. 797 of 2019).

The application stands allowed.
