JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 02-02-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 376 of the Indian Penal Code and Sections 3, 4 of the POCSO Act. Petitioner is said to have committed rape upon the minor daughter of the informant.
Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that the alleged date of occurrence is 17.02.2021 whereas the police has been informed about the said occurrence on 22.02.2021 and no cogent explanation has been given by the informant for inordinate delay. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.
Patna High Court CR. MISC. No.34466 of 2021(2) dt.02-02-2022 2/2 However, learned APP for the State opposes the prayer for bail and submits that petitioner has committed rape upon the minor girl of the informant.
Considering the nature of offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Bhagwanpur P.S. 51 of 2021.
