Having regard to the fact that the petitioners are facing prosecution for offence under Sections 341, 323, 506, 420, 467, 468, 471, 353(1) & 120 of the Indian Penal Code and that there is specific allegation against them to have not only taken away the truck of the informant but also changed the number plate for the purpose of its using and that the petitioners also support their claim on the vehicle in absence of their name recorded in the owner book, this Court, keeping in view that the prayer of the father of the petitioners for release of vehicle was also rejected, is not inclined to grant privilege of anticipatory bail to the petitioners.
Patna High Court Cr.Misc. No.45833 of 2014 (5) dt.23-07-2015 That being so, this application for anticipatory bail of the petitioners, namely, Jitendra Kumar and Dharmendra Kumar is hereby rejected but, nothing said in this order shall come in the way of the petitioners if they surrender and make a prayer for regular bail which shall be decided on its own merit without being prejudiced by this order.
