The petitioner is in custody since 23.10.2016, in connection with Complaint Case No. 541 of 2016, registered offences punishable under Section 37(b) and 30(a) Bihar Excise (Amendment) Act, 2016.

It has been submitted on behalf of the petitioner that the only allegation against the petitioner is that 12 litres of beer has been recovered from him and he was caught in drunken state, for which he has been languishing in judicial custody since 23.10.2016.

Heard learned A.P.P. also.

Considering the aforementioned facts and circumstances, nature of offence, the period of custody and also that the petitioner

Patna High Court Cr.Misc. No.53850 of 2016 (2) dt.15-12-2016 2/2 has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Complaint Case No. 541 of 2016.
