The application is for grant of bail in connection with Gaya Muffasil PS case no. 226 of 2016 for the offence under Sections 385 and 387 of the Indian Penal Code. It is submitted on behalf of petitioner that except confessional statement of co-accused implicating the petitioner, there is nothing against the petitioner and petitioner is in custody since 07.07.2016.
Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail and stated that petitioner has criminal antecedent and he could not point out as to whether there is anything else except the confessional statement of co-accused in
Patna High Court Cr.Misc. No.49173 of 2016 (4) dt.13-01-2017 2/2 the present case.
Having heard both sides. In view of the fact that except the confessional statement of co-accused implicating the petitioner there is nothing against the petitioner on the record and charge-sheet has already been submitted. As such, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Mofassil P.S. case no. 226 of 2016 with a condition that bailors should have the property within the jurisdiction of learned court below and he will cooperate in the disposal of the case.
