Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Patoryi P.S. Case No. 138 of 2023 dated 26.02.2023 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

The main submissions advanced by learned counsel for petitioner are that the instant matter relates to the recovery of 69.120 litres of foreign liquor and the same is stated to have been recovered from the petitioner's house, infact the owner of the alleged house is Jai Prakash Ray and petitioner is his wife and at the time of raid, all male members of the petitioner's family managed to flee away and petitioner was caught by the police mainly on account of being present in the said house.

Learned APP for the State opposes the bail prayer of the petitioner.

Considering the above submissions, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Patoryi P.S. Case No. 138 of 2023.
