2. The petitioner seeks pre-arrest bail in connection with Sahar P.S. Case No. 129 of 2023 registered for the offence(s) punishable under Sections 341, 323, 307, 504, 506, and 34 of the Indian Penal Code.

3. As per the allegation made in the FIR, the accused persons including the petitioner assaulted the informant and the brother of the informant. One of the injury is simple in nature and the other is grievous in nature.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and has falsely been implicated in the present case. There is a case and counter case arising out of the said incidence and due to

No.25679 of 2024(2) dt.09-08-2024 2/3 tumultuous talk, both the parties indulged into fierce fight leading to assault to each other and in the self-defence, petitioner may have caused some injury on the person of the informant's brother. The petitioner has no criminal antecedent.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the nature of allegation made against the petitioner, the petitioner, above named, is directed to be released on pre-arrest bail, subject to the condition that the injury sustained as a result of assault either to the informant or his brother is simple in nature, which will be verified by the learned District Court, in the event of his arrest or surrender before the Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Learned Judicial Magistrate First Class in connection with Sahar P.S. Case No. 129 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

7. The learned District Court is directed to verify the criminal antecedent of the petitioner as stated in paragraph no. 3 of the bail application. If any other case is pending against the petitioner as what has been stated in paragraph no. 3, this order

Patna High Court CR. MISC. No.25679 of 2024(2) dt.09-08-2024 3/3 will lose its force automatically.
