JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-10-2015 The matter has been listed out of turn on the prayer of learned counsel for the petitioner since the petitioner being the government servant deputed as 2nd Polling Officer in the ensuing Bihar Assembly Elections, 2015. A supplementary affidavit to that effect has been filed.

Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

The prosecution case is of killing the cousin of the informant after six years of marriage and disposing of the dead body.

It is submitted by learned counsel for the petitioner that the accusation is omnibus and general and the victim died after six

Considering the thrust of accusation against the husband of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Lakhisarai in connection with Suryagarha P.S. Case No.121 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
