JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-341, 504 and 307 of the Indian Penal Code and 25(ib)a/26/35 and 27 of the Arms Act. One automatic pistol and two live cartridges are said to have been recovered from possession of the petitioner, when police arrested the petitioner on the basis of information, given by the informant, who disclosed before the police that the petitioner had made firing on him but fortunately, he escaped unhurt. The petitioner is languishing in jail custody since 26-04-2016 and the investigation against him has already been completed. No doubt, the petitioner does have criminal antecedent but considering the above-said facts and circumstances

Patna High Court Cr.Misc. No.46629 of 2016 (2) dt.25-10-2016 2/2 of the case as well as period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Udwantnagar P.S. Case No. 186 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara.
