JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 2 01-09-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Saraiya P.S. Case No. 878 of 2019 for the offences under Sections 399,402 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel appearing on behalf of the petitioner would submit that the allegation against the petitioner is that from his possession, one country made pistol (Katta) and one Hero Honda motorcycle which belongs to wife of the petitioner, were recovered. Petitioner is in custody since 13.12.2019. Considering the fact that the petitioner has remained in custody for more than eight months, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each

to the satisfaction of the A.C.J.M.-1st (West) Muzaffarpur in connection with Saraiya P.S. Case No. 878 of 2019. Further, on release the petitioner shall render his service as volunteer to combat Covid pandemic for a period of month. He is required to report before the Civil Surgeon, Muzaffarpur-cum-Nodal Officer, Covid.
