The petitioner apprehends her arrest in connection with Shastri Nagar P.S. Case No.294 of 2009 registered under Sections 420, 468 and 471/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Patna. The allegation is that the petitioner was a candidate for appearing in the competitive examination of ANM Course. In course of examination, another lady appearing in her place affixing her photograph on the Identity-card of the petitioner was found.
Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.18262 of 2015 (3) dt.25-06-2015 2/2 submits that the petitioner is a lady.
Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within six weeks and prayer for regular bail, which shall be considered by the trial court on its own merit without being prejudiced by the order of this Court.
