The petitioner apprehends his arrest in connection with Angar Ghat P.S. Case No. 101 of 2014 registered under Sections 324, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act pending in the court of J.M. Ist Class, Dalsinghsarai, Samastipur.
The allegation of informant, Pankaj Rai, is that on 29.10.2014, he had gone to the house his brother-in-law, Ganesh Pandey. On 20.10.2014, he along with his brother-in-law, Ganesh Pandey, Shashi Ranjan Sharma @ Guddu and Manoj Choudhary, were going to Chhat Ghat on the occasion of Chhat Puja, when
Patna High Court Cr.Misc. No.47000 of 2015 (3) dt.27-01-2016 they reached at the Dam, Shivesh Paney shot fire at the belly of Ganesh Pandey. When the informant tried to save him then this petitioner shot fire at the belly of the informant. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
