This is an application for grant of regular bail for offences punishable under Sections 414/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that against the petitioner, only allegation is that stolen motorcycle was recovered from the possession of the petitioner which has been stolen of one Md. Ezaj and Md. Ezaj has also named the other accused person from whose possession also motor cycle has been recovered. It has further been submitted that the petitioner has actually purchased the motor cycle from Md. Ezaj. He has no intention to purchase the stolen article. Further, it has also been submitted that one co-accused have been granted bail by this Hon'ble Court by order dated 14.12.2016 passed in 48508 of
Patna High Court Cr.Misc. No.49065 of 2016 (3) dt.11-01-2017 2/2 2016.

Considering the facts and circumstances of the case and also the fact that the co-accused of this case has already been granted bail by this Hon'ble Court and the petitioner is languishing in judicial custody since 25.08.2016, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Raxaul at Motihari in connection with Darpa P.S. Case No.55 of 2016.
