Heard Mr. Prakash Chandra Jha, learned counsel for the petitioner and Mr. Bal Mukund Prasad Sinha, learned counsel for the State.

The petitioner, who is in custody since 02.02.2020 seeks bail in connection with Mahua P.S. Case No. 47 of 2020 instituted for the offences under Section 379 of the Indian Penal Code. Learned counsel for the petitioner has submitted that he is not named in the First Information Report and he has been made

accused in this case only on the basis of suspicion and confession of some of the accused persons. The Bolero vehicle, which is said to have been stolen, has been recovered with which the petitioner is not at all associated. The petitioner is stated to be a shop-keeper of a general store.

Regard being had to the afore-stated facts and the period of custody of the petitioner, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 47 of 2020.
