JUSTICE SUDHIR SINGH ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 376 of the Indian Penal Code and 66 of I.T.Act. The allegation against the petitioner is that on pretext of marriage, he has established physical relation with the informant, namely, Puja Kumari.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.07.2016. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The victim girl has been examined under Section 164 Cr.PC. where she has denied the allegation made in the FIR.

Patna High Court Cr.Misc. No.44415 of 2016 (2) dt.19-10-2016 2/2 On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Jamui P.S.Case No. 242 of 2016.
