JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 13-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Petitioner happens to be Gotni of deceased, Kiran Devi, who along with her husband Nageshwar Sah as well as husband of deceased namely Harinath Sah has been made an accused in this case at the instance of informant Ashok Kumar Sah, brother of deceased.

From perusal of the case diary, it is apparent that one set of witnesses have alleged it a case of murder, more particularly in the background of the illicit relationship in between the husband of deceased with Sunita Devi, while they were residing at Begusarai. The second set of evidence happens to be with regard to commission of suicide in the aforesaid background as has been stated by the neighbours of deceased recorded under Paras-18, 19.

Patna High Court Cr.Misc. No.44838 of 2014 (03) dt.13-04-2015 However, none had pointed out the petitioner having her involvement during course thereof. Moreover, her husband Nageshwar Sah had already been granted bail vide Cr. Misc. no.907 of 2015.

In the aforesaid facts and circumstances of the case, petitioner Sunita Devi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Saran at Chapra in connection with Maker P. S. Case no.52 of 2014, in event of her arrest/ surrender within four weeks in terms of condition so laid down under Section 438(2) of the Cr. P.C.
