JUSTICE VIKASH JAIN ORAL ORDER 20-03-2015 The present application has been filed for quashing the cognizance order dated 16.06.2012 passed by the learned Chief Judicial Magistrate, Banka, in Katoria P.S. Case No. 252 of 2009, G.R. No. 1988 of 2009 for the offence

Patna High Court Cr.Misc. No.41174 of 2012 (2) dt.20-03-2015 alleged under Sections 147, 149, 435 and 427 of the Indian Penal Code.

2. It is submitted that the petitioners have been falsely implicated which stands fortified by the very fact that after due investigation the police submitted final form exonerating the petitioners on the ground that there was no chance of identification of the accused.

3. A perusal of the impugned order of cognizance however discloses the same has been passed after taking into consideration the materials on record as well as several paragraphs of the case diary thereafter a prima facie case has been found against the petitioners.

4. In the above view of the matter, this Court is not inclined to entertain the application. Accordingly, the petition stands dismissed.

5. The petitioners shall be at liberty to raise all the points at the time of framing of charge.
