2. However, in view of the unconditional and unqualified apology tendered by the concerned ASO, the Court does not propose to deal with the issue any further and accordingly, the same stands consigned.

3. Nobody appears on behalf of the petitioners. Learned counsel for the State is present.

4. It appears that initially, the present case was being heard along with C.W.J.C. No. 4191 of 2005. However, on 29.08.2005, C.W.J.C. No. 4191 of 2005 was disposed off but the present case remained pending.

5. In the present case, by order dated 14.10.2004, a coordinate Bench had directed for release of kendu leaves in favour of the petitioners upon depositing 30% of Rs. 632/- per standard bag in the Bank. The State being aggrieved have preferred L.P.A. No. 1131 of 2004, which was disposed off by a common order along with L.P.As. No. 1129 and 1130 of 2004 on 29.11.2004, with a direction to deposit 100% of the consideration money by the purchasers subject to the result of the writ petition.

6. Having regard to the aforesaid and the fact that nobody had appeared to press the writ application on 26.11.2018 and even today there is no representation, the writ petition stands dismissed for non prosecution.
