The petitioner being husband of the complainant is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A,323,379 and 406 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demands.
The matter was referred to the mediation vide order dated 13.1.2015. Report of the Mediator at Flag - A suggests that
Patna High Court Cr.Misc. No.29646 of 2014 (3) dt.13-04-2015 2/2 the issue has been resolved.
Learned counsel for the complainant submits that the complainant is residing with the petitioner, though still the issue has not been finally resolved.
Considering the report of the mediator and the stand of the complainant that she is residing with the petitioner, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif in connection with Complaint Case No. 1061 C of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
