2. The petitioners are apprehending their arrest in connection with Khizersarai P.S. Case No. 348 of 2023, registered for the offences punishable under Sections 323, 341, 308, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, when the informant opposed the accused persons from making boundary with bamboo on government land from where Sarkari Jal Nal pipe was passing through, the petitioners assaulted the informant with iron rod and khanti.

4. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.26923 of 2024(2) dt.01-05-2024 2/2 petitioners are innocent and have falsely been implicated in this case due to land dispute. He further submits that the injury found on the informant is simple in nature. Petitioners have no criminal antecedent. Petitioners undertake to cooperate in the investigation and trial.

5. Learned APP opposes the prayer for anticipatory bail of the petitioners.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Khizersarai P.S. Case No. 348 of 2023, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
