Petitioner seeks bail in a case registered under Section-47(a) of the Bihar Excise Act.

76 pouches each containing 400 ml. country-made liquor and 13 bottles of O.C. Blue liquor are said to have been recovered from the cow shed of the petitioner but submission on behalf of the petitioner is that nothing had been recovered from house of the petitioner and as a matter of fact, the so-called recovery has been made in absence of the petitioner. The petitioner is languishing in jail custody since 14-07-2016 without having any criminal antecedent.

Accordingly, the petitioner named above, is

Patna High Court Cr.Misc. No.38693 of 2016 (2) dt.19-09-2016 2/2 directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Biraul P.S. Case No. 96 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, Darbhanga.
