JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The informant states that his three years old daughter was found missing from the house and, later on, he got information that his daughter was at Kasmara Sareh. Thereafter, the informant went there and brought his daughter to home and he noticed that blood was coming out from the nose and private part of his daughter. The villagers having got such information assembled there and when the informant asked from his daughter, the aforesaid three years old child pointed out her finger towards petitioner. Moreover, in course of investigation, one witness also stated that he had seen the petitioner carrying a girl in his lap on the alleged date of occurrence.

No.44700 of 2016 (3) dt.28-11-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and, hence, his prayer for bail in connection with Trial no. 10 of 2016, arising out of Pupri P.S.Case NO. 270 of 2015, pending in the court of 1st Additional Sessions Judge-cumSpecial Judge, POCSO Act, Sitamarhi, stands rejected.
