The petitioner is in custody since 24.09.2018 in connection with Case No. C2/505/18 for the offence registered under Sections 30 (A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that though the alleged recovery of 240 bottles of liquor are said to have been made from the petitioner, the said recovery was made from the motorcycle where the petitioner was also supposed to be one of the riders. It is further submitted that the petitioner has not committed any offence and he has clean past. Considering the aforesaid facts and circumstances of
