====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 10-04-2015 Heard learned counsel for the petitioners and the State. Petitioners are apprehending arrest in connection with a case registered for the offences under Section 379, other allied Sections of the Penal Code and Sections 135, 138 of the Electricity Act.
It is submitted on behalf of the petitioners that in spite of two orders of the High Court, Annexures-2, 4 revised demand has not been furnished but on the basis of the earlier demand raised First Information Report was lodged and petitioners, who are Director(s) of the flour mill are sought to be arrested. Let petitioner, named above, surrender in the court
Patna High Court Cr.Misc. No.41361 of 2014 (2) dt.10-04-2015 2/2 below within a period of four weeks from the date of receipt/ production of a copy of this order in the Court below and the court below will seek report from the Executive Engineer and if any revised demand in the light of the orders Annexures- 2, 4 has been served on the petitioners, they be asked to deposit the said demand and after deposit of the said amount be allowed the privilege of bail to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbisganj P.S. Case No. 299 of 2008. Until the report about the revised demand is received and final order is passed, no coercive steps be taken against them. (V.N. Sinha, J.) Rajesh/- U T
