Petitioner seeks bail in a case registered for the offences punishable under Sections 120B, 307, 302, 504 and 34 of the Indian Penal Code.

For dispute relating to plucking of mango, the petitioner, allegedly, assaulted with Chura to Bipin Kumar causing injury at different parts of the body including chest as a result whereof Bipin Kumar died. When the informant came for rescue he was also assaulted. The Doctor has found injury penetrating wound at the chest reaching up to the heart.

Submission of the petitioner is that in the occurrence, the petitioner also sustained serious injuries at the jaw, forearm and was referred for treatment to P.M.C.H. The petitioner

Patna High Court Cr.Misc. No.49518 of 2016 (3) dt.23-01-2017 2/2 is in custody since 14.06.2016.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail for the present in connection with Patory (Mohanpur O.P) Police Station Case No. 228 of 2016 pending in the court of learned Chief Judicial Magistrate, Samastipur. The learned court below is directed to expedite the trial.
