JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-09-2016 Heard learned counsels for the petitioners and the State. The petitioners are languishing in custody since 22.7.2016 in a case registered for the offences punishable under Section 20(b) of the NDPS Act.

From the house of the petitioner 1150 grams ganja were recovered from a polythene kept in a carry bag along with weighing equipments and cash of rupees four hundred eighty. It is submitted by the learned counsel for the petitioner that recovery is from the joint family house and it is slightly above small quantity. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Learned APP appearing for the State does not controvert

Considering the quantity of recovery and the petitioner having no criminal antecedent, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Supaul in connection with Special Case No. 7 of 2016.
