2. The petitioner is apprehending arrest in connection with Kotwali P.S. Case No. 80 of 2025 lodged on 01.09.2025, for the offences punishable under Sections 126(2), 115(2), 118(1), 110, 74, 352, 351(2) and 3(5) of the B.N.S., 2023.

3. As per the prosecution, FIR has been lodged against six named accused persons including the present petitioner with allegation that the petitioner had made dagger blow on the informant repeatedly due to which injury caused.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the informant and petitioner are full brothers

Patna High Court CR. MISC. No.23276 of 2026(3) dt.13-05-2026 2/3 and dispute has taken place between the agnates for family matter. He further submits that for the same date and place of occurrence, there are case and counter-case between the parties. He further submits that the FIR has been lodged on 01.09.2025 and the said occurrence took place on 17.08.2025, i.e., delay of about 14 days.

5. Counsel submits that the criminal antecedent of the petitioner is clean and on the previous occasion, case diary has been called for.

6. Learned APP for the State opposes the prayer for bail of the petitioner and submits that dispute is between the agnates and there are case and counter-case between the parties. He also submits that the FIR has been lodged with delay of 14 days and injury has been caused by sharp cutting weapon, which is grievous in nature.

7. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of CJM, Darbhanga, in connection with Kotwali P.S.
