JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-06-2020 Mr. Sunit Kumar Srivastava, learned counsel appearing on behalf of the petitioner prays that the defects, as pointed out by Stamp Report, dated 23.06.2020, will be removed within two weeks just after starting the functioning of physical Court.

In view of the undertaking, the prayer of the learned counsel for the petitioner is allowed.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the state through video conferencing.

The petitioner seeks bail in connection with Mokama P.S. Case No. 19 of 2020 (Special Case No. 1426 of 2020), registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

On receiving the secret information about carrying the

No.21165 of 2020(2) dt.29-06-2020 2/2 liquor, the informant, along with other police personnel, reached at Kanhaipur Halt, then, on seeing the police party, several persons were seen fleeing away. On chase, two persons were apprehended, who disclosed their names Pramod Bhagat and Pintu Kumar (petitioner) and they also disclosed the names of their associates as Karu Paswan, Pankaj Kumar, Satyanand Paswan, Shere Bihar Paswan and Kunal Paswan. On search, two gallons were found containing 50 liters of country made liquor.

Submission is that the petitioner has no criminal antecedent and is in custody since 11.02.2020. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Mokama P.S. Case No. 19 of 2020 (Special Case No. 1426 of 2020) to the satisfaction of the Special Judge, Excise, Patna. (Rajendra Kumar Mishra, J) Shamshad/- U T
