JUSTICE ALOK KUMAR SINHA ORAL ORDER 08-07-2025 Heard learned counsel for the petitioner, learned counsel appearing for Patna Municipal Corporation, Patna and learned counsel appearing on behalf of the State.

2. With the consent of all the parties this writ application is being disposed of at this stage itself.

The learned counsel for the petitioner submits that for the relief as claimed in the present writ application, the petitioner has already filed representation before the Municipal Commission, Patna under Section 32 of the Bihar Apartment Ownership Act, 2006 (Annexure P/4) on 18.02.2025, which as per the petitioner continues to be pending before the Municipal Commissioner.

4. Learned counsel for the petitioner submits that he would be satisfied if an appropriate direction is issued to the Municipal Commissioner, Patna to dispose of the representation of the petitioner within a fixed time frame after giving an opportunity of hearing to the petitioner.

5. Considering the nature of prayer made by learned counsel for the petitioner, the respondents do not have any objection.

6. Taking into account the formal nature of prayer made by learned counsel for the petitioner, this writ application is being disposed of directing the Municipal Commissioner Patna to dispose of the representation of the petitioner dated 18.02.2025 (Annexure P/4) after giving an opportunity of hearing to the petitioner within four months from the date of production of a copy of this order.

7. The final order which shall be passed by the Municipal Commissioner shall be reasoned and speaking order.

8. With the aforesaid observation and direction, the present writ application is disposed of.
