The petitioner seeks bail in connection with Case No. 161 C-2 of 2016 registered under Sections 30(a) and 38(1) of the Bihar Prohibition and Excise Act, 2016.

Allegation, in brief, is that the excise officials alleged to have recovered approximately 4 litres in total foreign liquor from the possession of the petitioner.

Learned counsel for the petitioners submits that there is no recovery but, as per allegation, only 4.125 litres is said to have been recovered from the petitioner and he is in custody since 27.10.2016 and has got no criminal antecedent.
