The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

Allegation against the petitioner is that he gave a dagger blow, as a result whereof, mother-in law of the informant died. Two other eye witnesses have also supported the allegation. In the past, prayer for bail was refused on 02.05.2019 vide order at Annexure-2. Petitioner is in custody since 26.05.2018.

The report of the trial Judge would reveal that six prosecution witnesses out of nine have already been examined and for examination of other prosecution witnesses, necessary steps have been taken. The effect of COVID had disturbed the

Patna High Court CR. MISC. No.22335 of 2021(3) dt.08-09-2021 2/2 progress of the trial.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail in connection with G.B. Nagar P.S. Case No. 153 of 2018.

Hence, prayer is refused.
