2. On earlier date also, no one appeared on behalf of the petitioner.

3. The petitioner has challenged the order dated 22.10.2016 whereby his petition to recall PW- 4 and 5, in Sessions Trial No. 908 of 2014 was rejected by the Vth Additional Sessions Judge, Munger.

4. The learned 5th Additional Sessions Judge, Munger has mentioned in his order that there was direction of this Court to disposed of the trial within a period of three months and only with an intention to delay the sessions trial, the petitioner has filed the petition to recall PW-4 and 5.

5. I do not see any irregularity, impropriety and illegality in the impugned order.

6. Accordingly, this Criminal Miscellaneous application is dismissed.
