2. This writ application has been filed for directing respondent no. 4, D.C.L.R., Rajgir, Nalanda to dispose of the Mutation Appeal No. 568 of 2025-26 within reasonable time.

3. Learned counsel for the petitioners submits that Mutation Appeal No. 568 of 2025-26 was filed by the petitioners against the mutation order dated 03.10.2025 passed by the Circle Officer, Rajgir in Mutation Case No. 1523 of 2025-26. It is further

Patna High Court CWJC No.6476 of 2026(2) dt.12-05-2026 2/2 submitted that in mutation proceeding the objection was raised by the petitioners with regard to pendency of title suit bearing Title Suit No. 128 of 2019 before the competent Civil Court for the same land, nonetheless, the Circle Officer, Rajgir allowed the aforesaid mutation case. The Circle Officer had no jurisdiction to pass an order and allow the mutation case when title suit with regard to the same land between the parties is pending before the competent Civil Court, which is in teeth of Section 6(12) of the Bihar Land Mutation Act, 2011.

Since the Mutation Appeal No. 568 of 2025-26 is pending before the D.C.L.R., Rajgir, Nalanda against the order dated 03.10.2025 passed by the Circle Officer, Rajgir in Mutation Case No. 1523 of 2025-26 , the D.C.L.R., Rajgir, Nalanda is directed to dispose of the aforesaid mutation appeal in accordance with law within a period of two months from the date of receipt/production of a copy of this order.

5. Accordingly, this writ application is disposed of with the aforesaid observations.
