ANJANA MISHRA ORAL ORDER 14-01-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Bhabua P.S. Case No. 498 of 2014, registered for offences punishable under Sections 341, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that there is no specific allegation attributed to these petitioners and their names have been brought into the present case only on account of mischief of some co-villagers. It is further submitted that the petitioner no. 1, Anup Singh has already lodged an F.I. R against informant Nagina Singh and his son under Section 307/34 I.P.C bearing Bhabua P.S. Case No. 219 of 2011, which is still

Patna High Court Cr.Misc. No.46831 of 2015 (3) dt.14-01-2016 2/2 pending evidence and only on account of this F.I.R., the names of the present petitioners have been brought into the present case. Learned counsel for the petitioner further submits that one Pramod Patel @ Pramod Singh, similarly situated person has been extended the privilege of anticipatory bail in Criminal Miscellaneous No. 15554 of 2015 vide order dated 27.05.2015, Considering the aforementioned facts and circumstances and also fairly submitted that both the petitioners are involved in one other case, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 498 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
