JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2017 This is an application for grant of bail for offences punishable under Sections 302/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that the occurrence took place due to previous issue of keeping the shop in the Marukiya Hatia. There was no intention to assault the deceased but he died and petitioner is in custody since 03.09.2016. Now the parties have compromised the matter.
Heard learned A.P.P. also.
Having heard both sides, in view of the facts and circumstances, I am not inclined to grant bail to the petitioner, the same is rejected.
However, the trial court, i.e., Judicial Magistrate, Ist Class, Jhanjharpur, Madhubani, is directed for commitment of the
Patna High Court Cr.Misc. No.1056 of 2017 (3) dt.03-04-2017 2/2 case and conclusion of the trial within a period of seven months from the date of receipt/production of a copy of this order. If the trial is not concluded with the aforesaid period, petitioner is at liberty to renew his prayer for bail before the court concerned. Accordingly, this application is dismissed.
