Petitioner apprehends his arrest in Gopalganj Town P.S. Case No.42 of 2019, registered under Sections 363, 366A and 34 of the Indian Penal Code.

The mother of the victim alleged that the petitioner and his son, Ankesh Kumar kidnapped her daughter. Learned counsel for the petitioner submits that in fact Ankesh Kumar was having love with the victim and the victim left her house out of her free will and without any force. The victim made her statement under Section 164 Cr.P.C. and she disclosed that since she was in love with the son of the petitioner and her parents wanted to get her married with another person, she left her house and she was residing in the house of Ankesh Kumar. Having considered the facts aforesaid, let petitioner, above named, who is the father of Ankesh Kumar, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj in connection with Gopalganj Town P.S. Case No.42 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
