The petitioners apprehend their arrest in Garkha P.S. Case No. 10/2017, registered for the offences punishable under Sections 302/34, 120(B), 504 and 506 of the Indian Penal Code. The informant filed complaint petition alleging that the accused persons killed her daughter and disposed of her dead body. The petitioners are mother-in-law and sister-in-law of the deceased. The deceased was married to Brij Kishore Singh @ Raj Kishore @ Tunnu Singh in the year 2009 and the deceased had three children. The deceased never complained of ill-treatment at the hands of the petitioners. The husband of the deceased and his second wife have already been enlarged on anticipatory bail vide
Patna High Court Cr.Misc. No.23867 of 2017 (2) dt.14-07-2017 2/2 order passed in Cr. Misc. No. 17754/2017 by a co-ordinate Bench of this Court. The case of the petitioner stands on the better footing.
It appears that the petitioners are mother-in-law and sister-in-law of the deceased. They have stated that they are living separately from the family of the deceased.
Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Garkha P.S. Case No. 10/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
