The petitioner, who is in custody since 18.02.2020 seeks bail in connection with Trial No. 3294/2018 (arising out of Masrakh P.S. Case No. 203/2018) dated 21.06.2018 instituted for the offences under Sections 30, 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016. It appears from the First Information that four persons were arrested with liquor and those persons have disclosed the name of petitioner. Hence, the prosecution of the petitioner in the present case.

No.21909 of 2020(2) dt.09-07-2020 2/2 It has been submitted on behalf of the petitioner that he has been made accused in this case at the instance of local police because of the earlier cases having been lodged against him about which reference has been made in paragraph - 3 of the bail petition. In the present case there is no recovery from the petitioner and his implication is only on the basis of statement of an arrested accused person. Regard being had to the afore-stated facts, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge-cumSpecial Judge, Excise, Saran, in connection with Trial No. 3294/2018 (arising out of Masrakh P.S. Case No. 203/2018).
