Petitioner, Arun Kumar, is in custody since 07.08.2016 in connection with Turkaulia P.S. Case No. 345 of 2016 registered under Section 414 of the Indian Penal Code.

Allegation against the petitioner is of theft of one motorcycle.

4. Learned counsel for the petitioner submitted that the petitioner is a motorcycle mechanic and only on the basis of suspicion his name has been dragged in the present case. The alleged motorcycle had come to the petitioner for its repairing and when he was taking trial of the said motorcycle, he was intercepted. The petitioner, without having any criminal antecedent, languishing in judicial custody since 07.08.206.

Considering the facts and circumstances of the case, nature of offence, period of custody of this petitioner and the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, East Champaran at Motihari in connection with Turkaulia P.S. Case No. 345 of 2016.
