Heard the learned counsel for the petitioners as well as the Mr. Pranav Kumar, the learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with Muffasil (Lakhaura) P.S. Case No. 416 of 2021, registered

Patna High Court CR. MISC. No.23095 of 2022(2) dt.12-10-2022 2/3 for punishable under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code and section 27 of the Arms Act. As per allegation, the named accused persons assaulted the informant. There is specific allegation against petitioner no. 2 that he assaulted the informant with farsa on his head. The learned counsel for the petitioners has submitted that there is case and counter case and the petitioners are the persons of clean antecedents. He has submitted further that the members of defense side has lodged a case against the members of prosecution side for outraging the modesty of a girl, who is a family member of the defense side.

Considering the above-mentioned facts and circumstances, especially the clean antecedents of the petitioners, let them, in the event of their arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Muffasil (Lakhaura) P.S. Case No. 416 of 2021, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove,
