Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends her arrest in connection with Bettiah Town P.S. Case No. 523 of 2021, registered for the offences punishable under Section 379 of the Indian Penal Code.

The learned counsel for the petitioner has submitted that the petitioner Sonamati Kumari is merely owner of the tractor bearing registration no. BR22GB-3109 wherefrom some stolen pipes were recovered. He has submitted further that she

Patna High Court CR. MISC. No.22916 of 2022(2) dt.10-10-2022 2/2 had no concern with the consignment. She was not even aware with the articles loaded on the tractor and she is a lady of clean antecedent.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of her arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Town P.S. Case No. 523 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
