The petitioner seeks bail in connection with Hawai Adda P.S. Case No. 214 of 2014 registered under Sections 420, 467, 468, 471, 406 and 120B of the Indian Penal Code, pending in the Court of Judicial Magistrate, 1st Class, Patna. The prayer of the petitioner for bail was rejected earlier on 05.10.2015 by this Court vide Criminal Miscellaneous No. 24231 of 2015 on merit.
Perused the Memo No. 78, dated 29.10.2016 of SubJudge-XII-cum-ACJM, Patna, which shows that charge has been framed against the petitioner and he expected to conclude the trial
Patna High Court Cr.Misc. No.39262 of 2016 (3) dt.07-12-2016 2/2 within 3 to 6 months. Since, prayer of the petitioner for bail has already been rejected on 05.10.2015 by this Court vide Criminal Miscellaneous No. 24231 of 2015 on merit, I find no fresh ground to re-consider the prayer of the petitioner for bail. Accordingly, prayer of the petitioner for bail is again rejected. However, Sub-Judge-XII-cum-ACJM, Patna is directed to conclude the trial of the petitioner within six months by taking all steps. If the trial of the petitioner is not concluded within the aforesaid period of six months, the petitioner would be at liberty to renew his prayer for bail.
