The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/34of the Indian Penal Code and section 27 of the Arms Act.

As per prosecution case, informant came to know that petitioner caused fire arms injury to Nilendu Pratap Singh. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner submits that there is no eye witness of the occurrence and even informant has not disclosed the source of identification of the petitioner. It is further submitted that there is delay of 6 days in lodging of the FIR and there is no plausible explanation of delay. Police after investigation

Patna High Court CR. MISC. No.23956 of 2022(2) dt.12-09-2022 2/2 submitted final form against the petitioner but differing with the same court took cognizance of the offence. Petitioner has got no criminal antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Khagaria in Gogri Police Station Case No. 179 of 2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
